Malaysia's Freedom of Speech Under Fire? Lawyers for Liberty vs. Anwar & Police (2026)

In a bold move, Lawyers for Liberty (LFL) has taken a stand against the recent police investigations, calling them a direct attack on free speech and democracy. But is this a fair assessment, or is there more to the story?

The human rights NGO, LFL, has fired back at the police's announcement regarding an ongoing investigation into an alleged plot to destabilize the government. The police statement, released on Feb 27 in Kuala Lumpur, claims that a prominent individual and an international media agency are under scrutiny for attempting to undermine national stability. LFL argues that this investigation is a blatant violation of freedom of expression and democratic values.

The controversy stems from the Inspector General of Police's statement, which reveals an inquiry into an influential person's alleged involvement with Bloomberg, a renowned media organization, to weaken parliamentary democracy. LFL's director, Zaid Malek, believes this investigation is clearly linked to Bloomberg's exposé on corruption within the Malaysian Anti-Corruption Commission (MACC), which has led to public demands for a royal commission of inquiry.

Zaid questions the timing of the police investigation, which coincides with calls for authorities to address the corruption allegations. He argues that Section 124B of the Penal Code, enacted in 2012, has a history of being used to silence dissent. This section criminalizes activities deemed harmful to parliamentary democracy, which, according to Section 130A, includes attempts to overthrow or undermine it through violent or unconstitutional means.

Zaid points out that this provision was created shortly before the Security Offences (Special Measures) Act 2012, and it has been used to target critics in the past, notably during the 1Malaysia Development Bhd (1MDB) scandal. Activists, civil society members from Bersih, journalists, and opposition figures were among those investigated under this law.

Zaid directs his criticism towards Prime Minister Anwar Ibrahim, reminding him of the law's previous targets, including Tony Pua and Rafizi Ramli, and the current Deputy Minister Adam Adli Abd Halim, who was arrested under the same provision in 2013. He challenges Anwar's memory of the law's oppressive nature and its impact on those who spoke out against the 1MDB scandal.

Zaid further argues that the investigation goes against the government's reform agenda and that corruption allegations, especially those involving MACC Chief Azam Baki, are of public interest and should be openly discussed. He emphasizes that Azam Baki and MACC are not part of parliamentary democracy, rendering the investigation baseless even within its intended scope.

Controversially, Zaid asserts that Section 124B is unconstitutional and contradicts Article 10(1)(a) of the Federal Constitution, which protects freedom of expression. He believes this section was designed to intimidate and silence dissent, as evidenced by its use against government critics in the past.

Zaid urges Anwar's government to cease the investigation immediately, warning that continuing it would associate the administration with undemocratic practices. He advocates for the protection of free speech and the fight against corruption, calling for an end to the investigation under the unconstitutional Section 124B.

Zaid's statement raises questions: Is the government truly committed to its reform agenda and the fight against corruption? Should the investigation continue, who should be held accountable for any harm to democratic principles? And what does this mean for the future of free speech and democracy in the country?
